Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Kaivion governing your access to and use of the Kaivion website, dashboard, and related features (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. We have tried to keep them readable. If anything is unclear, write to us at Kaivionsupport@gmail.com.

What Kaivion is

Kaivion is a tool that helps you track loyalty points, miles, and credit card rewards across multiple programs. You provide balance information through any of the methods we support (manual entry, screenshot upload, email forwarding, a connected Gmail account, or future additions). Kaivion estimates the approximate dollar worth of those balances and surfaces redemption opportunities, expiration warnings, and related insights.

No affiliation

Kaivion is an independent service. We are not affiliated with, endorsed by, or sponsored by any airline, bank, credit card issuer, hotel chain, or loyalty program shown in or referenced by the Service. Brand names and program names appear only to identify what you are tracking; they remain the property of their respective owners.

Program rules, point values, transfer ratios, award charts, and availability change frequently and without notice. The information you see in Kaivion may be out of date for any individual program at any given moment. You agree to verify rates, rules, and availability directly with the relevant program before booking, transferring, or otherwise acting on what you see here.

Your account

  • You must be 18 or older to create an account.
  • You are responsible for keeping your credentials secure and for all activity that occurs under your account.
  • You may permanently delete your account at any time from /delete-account when signed in. Deletion is immediate and irreversible.
  • One person, one account. You may not share login credentials or operate the Service on behalf of an organization without our written consent.

Subscriptions and billing

Some features are offered under a paid plan (Kaivion Pro). The current price and options are shown on the subscribe and billing pages before you pay.

  • Billing and renewal. Paid plans are billed in advance through our payment processor, Stripe, and renew automatically at the end of each billing period (monthly or annual, as you choose) at the then-current price, until you cancel. By subscribing you authorize this recurring charge.
  • Cancellation. You can cancel anytime from your billing page. Your Pro access continues until the end of the period you have already paid for, and you will not be charged again after that.
  • Refunds. If you cancel within 7 days of a charge, email us and we will refund that charge in full. After 7 days we do not refund the portion of a period already paid, except where required by law.
  • Price changes. We may change prices. If a change affects your plan, we will give you notice before it takes effect, and it will apply from your next renewal. Promotional or early-adopter pricing applies only as described at the time you subscribe.
  • Taxes and failed payments. Prices may not include applicable taxes, which may be added at checkout. If a renewal payment fails, we may retry it and may suspend Pro access until payment succeeds.

Acceptable use

You agree NOT to:

  • Use the Service to violate any law or third-party right.
  • Reverse engineer, decompile, scrape, automate, or otherwise attempt to extract source code or underlying data from the Service, except as expressly permitted by law.
  • Use bots, headless browsers, scrapers, or any other automated means to interact with the Service outside of normal product use.
  • Impersonate any person or entity.
  • Use a display name that contains profanity, hate speech, slurs, sexual content, or content that disparages Kaivion or other users. We screen display names automatically. If your real name is flagged in error, you may press through with the in-product override; we may follow up and may require a change.
  • Resell, redistribute, republish, or commercially exploit any data, search results, or other output of the Service. All such output is licensed solely for your personal, non-commercial use.
  • Bulk-export data or share it with third-party services without our written permission.
  • Attempt to interfere with, disrupt, or compromise the integrity, security, or performance of the Service.

We reserve the right to suspend or terminate any account that violates these Terms, with or without notice, at our sole discretion.

Award search — personal use only

Award flight search features within the Service are made available under personal-use terms. By using these features you agree:

  • To use availability information shown in Kaivion solely to inform your own travel decisions.
  • Not to screenshot, copy, repost, syndicate, or otherwise share search results publicly, including on social media, forums, blogs, or other applications.
  • Not to run searches in any manner that simulates or amounts to commercial resale of the underlying data.
  • That Kaivion is rate-limited per user. Attempting to circumvent the rate limit, including by using multiple accounts, may result in suspension.

Accuracy of information; no advice

Point values shown in the Service are estimates based on publicly published average redemption rates. Actual redemption value will vary. Expiration dates rely on what you enter and what each loyalty program publishes; program rules change frequently. Currency conversions use external reference rates that may differ from the rate you actually receive when converting money. You agree to verify all information directly with the relevant program before making any decision.

Nothing in Kaivion constitutes financial, tax, investment, legal, or travel advice. Decisions about credit card applications, travel purchases, point transfers, and redemptions are yours alone.

Intellectual property

All software, design, content, and trademarks comprising the Service are owned by Kaivion or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. No other rights are granted. You retain all rights in any data you input, subject to the licenses you grant us to operate the Service.

Activity logging

For security, abuse prevention, and product analytics, we record certain actions on your account, including signup, sign in, search activity, and your acceptance of these Terms. This is described in our Privacy Policy. By using the Service you consent to this logging.

Service provided as-is; disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.

We make commercially reasonable efforts to keep the Service running and the information current, but we do not warrant that the Service will be uninterrupted, error-free, or that any data displayed will be accurate or complete.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KAIVION, ITS OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF POINTS, MILES, REWARDS, PROFITS, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED IN WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

Our aggregate liability for any claim arising from or related to these Terms or the Service shall not exceed one hundred US dollars ($100).

Indemnification

You agree to defend, indemnify, and hold harmless Kaivion and its officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third-party right.

Termination

You may terminate your use of the Service at any time by deleting your account. We may suspend or terminate your access at any time, with or without cause or notice, including for any violation of these Terms. Sections that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution.

Dispute resolution; governing law

These Terms are governed by the laws of the United States and the state in which Kaivion is principally operated, without regard to conflict-of-laws principles. You and Kaivion agree to first attempt to resolve any dispute informally by contacting Kaivionsupport@gmail.com. If we cannot resolve a dispute within sixty (60) days, any unresolved claim shall be brought exclusively in the state or federal courts located in that state, and each party consents to personal jurisdiction there.

Changes to the Service or these Terms

We may add, change, or remove features at any time. We may also update these Terms from time to time. For material changes, we will provide notice (such as by email or an in-product banner) before the change takes effect. Your continued use of the Service after the effective date of any update constitutes acceptance of the revised Terms.

Force majeure

We will not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, internet or telecommunications failures, or actions of upstream service providers.

Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kaivion regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign or transfer your rights under these Terms without our prior written consent; we may assign these Terms to any successor or affiliate without notice.
